The resurgence of the Japanese chemical again sued Seoul Semiconductor


Nichia Chemical Industry and Seoul Semiconductor Korea have added new disputes over the lawsuits of GaN-based luminescent components such as white LEDs. Nichia Chemical Industry announced that on September 16, 2008, Seoul Semiconductor filed a lawsuit against the European patent EP541373 held by the company. Nichia Chemical Industry said that the LED chips used in Seoul Semiconductor's high-power white LED Acriche series violated its European patents. Nichia has filed a lawsuit requesting Seoul Semiconductor to stop the infringement and compensate for the loss.

EP541373 is a patent relating to a method of manufacturing a p-type GaN-based semiconductor. It is related to a technique of applying a heat treatment at a high temperature of 400 ° C or higher to a GaN-based semiconductor film doped with a p-type impurity to activate a p-type impurity. Nichia Chemical Industry said that the patent for implementing this heat treatment is an indispensable source patent for mass production of GaN-based LEDs and LDs (laser diodes).

The patent for heat treatment of p-type GaN-based semiconductors was repeatedly touched by GIS-based blue LEDs and other companies in Japan around 2000. At that time, it was related to Japanese domestic patent No. 2540791. Many opinions hold that the patent is the strongest patent held by Nichia Chemical Industry. Nichia Chemical Industry said that the European patent (EP541373) is the European version of the domestic patent.

Japanese and Seoul Semiconductors often have disputes over Acriche overseas

Seoul Semiconductor has not yet officially commented on the lawsuit. Seoul Semiconductor said that in addition to the lawsuit, Nichia Chemicals filed a lawsuit against Seoul Semiconductor for Acriche in the United Kingdom, Germany and the United States. In the United States, the court is conducting a trial on whether or not Seoul Semiconductor has infringed Nichia Chemical's patent for the efficiency of light extraction inside the chip by providing bumps on the surface of the LED chip (US Patent 6870191).

In response to the US patent, Seoul Semiconductor stated that it is natural to set up bumps and light extraction efficiency, and patents are not creative. We did not use this patent at all (Seoul Semiconductor Japan Branch Seoul Semiconductor, Japan). The litigation in the UK and Germany relates to European patents relating to the layer structure used to increase the output power (EP0599224A1, EP0622858A2).

Acriche is mainly used in lighting fixtures and is characterized by the ability to illuminate directly with an AC power source. No need to use an AC-DC converter. Seoul Semiconductor plans to use Acriche as the core to cultivate lighting sources as the next business pillar, so it is impossible to make concessions in the dispute with the Japanese chemical industry.
